These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the website (https://gowiz.eu) and all of its subdomains operated by Gowiz Technologies OÜ ("us", "we", or "our").

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Unless otherwise defined in this Terms of Service, the terms used in this Terms of Service have the same meanings in our Privacy Policy, accessible from https://gowiz.eu/privacy

Definitions


Here you can find the meanings of the most important terms in this Terms of Service (TOS) to help you understand who and for what we are Processing your Data.

API -   Application Programming Interface - a program that allows authorized users to access information from different Gowiz services.

Customer -   a natural person or a legal entity that has purchased on or many of our services.

Gowiz-bot -   the name of the Gowiz spider

Terms of Service - this terms of service document.

Third-party site owner - the owner of the third party website that is visible in the search results page or through our API

Spiders -  special programs that are used to crawl and index webpages.

Purchases and donations


If you wish to purchase any product or service made available through the website or you which to support us through donations ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation:

(i) Credit card number;
(ii) Credit card expiration date;
(iii) Billing address;
(iv) Shipping address.

You represent and warrant that:
(i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase;
(ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to:

(i) Product or service is not available;
(ii) Price of the product is not correct;
(iii) Violation of terms of services;
(iv) fraud, unauthorized, illegal transaction;
(iv) Other reasons.

Contests and Promotions


Any contests or other promotions ("Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy.

If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Subscriptions


Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). The subscription fee reefers to the usage in the previous billing cycle. Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

The amount charged at the start of the billing cycle may be different from the previous cycle. This may be bigger, if in the previous billing cycle you used our services more than before, or smaller if the usage was considerably smaller. All of the rules that govern the amount we charged are defined in the subscription page and detailed usage statistics are provided with each invoice.

If your service usage in a single billing cycle is less than the free tier then we don't charge you for that billing cycle. This applies to customers, how have selected a paying plan as well as customers who are using a free plan.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team.

A valid payment method, including a credit card, is required to process the payment for your Subscription. You shall provide us with accurate and complete billing information including. By submitting such payment information, you automatically authorize Gowiz Technologies OÜ to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, we will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Fee changes


Gowiz in its sole discretion and at any time may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

We will provide you with reasonable prior notice of any change in Subscription fees to allow you to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds


Certain refund requests for Subscriptions may be considered by us on a case-by-case basis and granted in the sole discretion of Gowiz Technologies OÜ.

Free trials


Gowiz may, at its sole discretion, offer a Subscription with a free trial for a limited period ("Free Trial").

You may be required to enter your billing information to sign up for the Free Trial.

If you do enter your billing information when signing up for the Free Trial, you will not be charged by us until the Free Trial has expired. On the last day of the Free Trial period, unless you canceled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice we reserve the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Free Services


Some of the services that we provide are free to some customers, while not free for others. Some nonprofit organizations, such as NGOs, academic organizations and students, are eligible for using our paid services for free. To qualify for that, you are required to contact our customer support team who may request some documents and information, to verify the given information.

If your application was denied, then you can apply again after every 30 days, unless we have told otherwise.

If we or one of our partners finds out that the information provided by you is not correct and you have used our paid services for free, we’ll convert your plan to a paying plan and issue an invoice for the services that you used for free. Unless this invoice is paid, we have to right to block your access to some of our services.

Accounts


When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Termination


We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Affiliate links


Some of the third party links available though our services are affiliate. This means that if one of our customers of visitors clicks on the link and completes a necessary action, such as but not limited to:
(i) buying a product;
(ii) subscribing to a service;
(iii) booking an appointment;
(iv) other activities;

Gowiz receives a fee from the third-party service provider. The size of the fee is dependent on multiple factors, such as the product category, product price and ordered quantity.

We don't distinguish affiliate links from other search results, because all search results are organic. This means that non-affiliate links and affiliate links have the same chance, ceteris paribus, of appearing in the same position. We are evaluating the site on its features and the way visitors and customers are interacting with it, not if it is an affiliate link or not.

Gowiz does not track if a click on the affiliate link leads to purchase on the third-party site. This is done by the third party. We advise you to study the TOS and Privacy Policy of the third party sites you visit.

Service availability


We are constantly updating and improving our search services. Rapid improvement can result in periods, where our services are not fully available.
There are also times of planned maintenance, where we are deliberately making our services not available. Visitors and customers are informed well in advance for such planned maintenance dates.

Our team is working hard to reduce downtime to an absolute minimum.

Broken links


Sometimes the underling search results links are broken, which means that the resource, that was crawled by one of our spiders, is currently not available. This is caused by the fact that the third-party site owner has removed that link.

We are constantly removing broken links from our Index.

Inaccuracies


Gowiz has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

We are doing everything we can to prevent such pages from ranking high on our services.

Irrelevant results


Sometimes the ordering of the results produced by our services is not as good as it good be. Our models are trying to produce the best overall ranking, which sometimes results in sub-optimal results ranking for an individual query.
Our team is working hard to improve the ranking results and provide our visitors and customers with the best ranking results. We encourage you to report such instincts.

No person, natural or legal, can directly influence the ranking provided by our services. This ensures that the search results are free from human bias.

Crawling


Spiders are used to retrieve information from third party websites to satisfy the information needs of our customers and visitors.

When crawling a domain or an individual web page, Gowiz bot respects the crawling policy specified by the site owner. Unless special rules have been applied to Gowiz-bot, we follow the rules specified to User-Agent: *.

We encourage site owners, who feel that we are violating their crawling rules to update their crawling rules for Gowiz-bot or to contact us.

Third-party site owners can ask us to crawl their domain more often, which we may or may not follow.

Content


Some of our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

(i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms;
(ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Governing Law


These Terms shall be governed and construed following the laws of Estonia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

In no event shall Gowiz nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use the Service;
(ii) any conduct or content of any third party on the Service;
(iii) any content obtained from the Service;
(iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Changes


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material we will try to provide at least 30 days' notice before any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Customer support


When contacting customer support, we may record the conversation, or save the email conversation, between us and visitors or customers, to protect our and their interests and to improve the service quality.

Currently, we are offering customer support in English and Estonian. We are always adding more languages. Our team aims to answer to queries with 1 workday on weekdays and within 3 workdays on weekends.

Customer support can answer your questions about the following questions:
(i) Your order details;
(ii) Your service usage;
(iii) Other questions;

Customer support can not adequately answer questions about a specific query, because they don't have the necessary information to do so.
